Trump is awaiting a court hearing on rape
Budrigannews.com – The scheduled defamation trial of Donald Trump by a writer who accused the former president of rape was postponed by two months on Tuesday by a U.S. judge.
E. Jean Carroll has been given an April 10, 2023 date by U.S. District Judge Lewis Kaplan in Manhattan to try to show that Trump lied when he said he didn’t rape her 27 years ago in a Bergdorf Goodman dressing room.
Kaplan did not decide whether Carroll should have a single trial that combines the lawsuit she filed against Trump in November 2019 against the former longtime columnist for Elle magazine with a second lawsuit she filed last week against Trump alleging that he abused her.
The Adult Survivors Act, a new law in New York that gives sexual assault victims a one-year window to sue for alleged attacks that occurred long ago even if statutes of limitations have run out, was the basis upon which Carroll, 78, brought that case.
Trump, who is 76 years old, opposed merging the lawsuits, and his lawyers stated that they were unsure of who would represent him in the second one. He had requested that the first lawsuit be tried on May 8, 2023.The initial time was on February 6.
Roberta Kaplan, Carroll’s attorney, stated that she was satisfied with the new trial date and comprehended the decision to postpone rulings in the second case. Damages are not specified in either suit.
Requests for clarification were not immediately answered by Trump’s lawyers.
Carroll made the rape claim in her memoir, and she filed a lawsuit against Trump after he claimed not to know her and said she was “not my type” in June 2019.
As appeals courts consider whether Trump was acting as president when he scoffed at the rape claim, the filing of her first lawsuit has been postponed.
Since the government cannot be sued for defamation, if he were, the United States of America would take on the role of defendant and the initial suit would fail.
In addition, Carroll asserts defamation in connection with a social media post on October 12 in which Trump reiterated his denial and referred to the rape claim as a “hoax” and “lie.”
Because Trump hasn’t been president since January 2021, immunity probably wouldn’t be a problem there.
