The judge denied Trump’s claim
Budrigannews.com – In a lawsuit brought by New York Attorney General Letitia James, former U.S. President Donald Trump, three of his adult children, and the Trump Organization are accused of fraudulently overvaluing the real estate company’s assets and Trump’s wealth. A New York judge has set the trial for October 2023.
Following the Trumps’ motions the night before to have the civil lawsuit dismissed, Justice Arthur Engoron of the state Supreme Court in Manhattan set the trial date during a contentious hearing on Tuesday.
“I made a decision on all these issues. My impression is that the facts are the same. The law is identical.”Parties are the same,” Trump’s attorney Alina Habba was informed by Engoron. After losing, you can’t keep making the same argument.”
Habba had said that the judge was unfair.James, a Democrat, has been accused by Trump, a Republican, of suing him because she doesn’t like him or his politics.
James claimed in her lawsuit, which she filed on Sept. 21, that Trump, his company, his children Donald Jr., Eric, and Ivanka, as well as other individuals, had inflated Trump’s assets by billions of dollars through a decade of lying to banks and insurers. The fraud was “staggering,” according to James.
Damages of $250 million are sought in the complaint.Additionally, it aims to prevent the Trumps from operating businesses in the state and prohibit Trump and his company from purchasing real estate in New York for a period of five years.
By the beginning of January, Engoron is anticipated to rule on the motions to dismiss.Trump has already filed an appeal against Engoron’s decision to appoint an independent watchdog to oversee his business.
The trial, which is scheduled for October 2, 2023, and other legal issues may make Trump’s announced 2024 presidential campaign more difficult.
The Trump Organization is currently being tried for tax fraud in a different Manhattan courtroom.
Additionally, last week, U.S. Attorney General Merrick Garland appointed a special counsel to oversee two criminal investigations, one pertaining to the FBI’s seizure of government documents from Trump’s
Florida residence and the other examining Trump’s role in efforts to overturn the 2020 election.
In addition, a criminal investigation into Trump’s involvement in the state of Georgia’s 2020 election is underway.
He has branded Engoron a “puppet judge” for James and referred to these cases and investigations as being politically motivated.
Trump claimed that the attorney general lacked authority to pursue a lawsuit designed to “get” him when neither the public nor the marketplace were harmed in his attempt to have the case against James dismissed.
“Apart from the politically compromised Attorney General of the State of New York, who stands to gain from this highly politized fare ()?”In Trump’s filing,
Dismissals were also urged by other defendants.
The lawsuit was described by the lawyers for Trump’s sons as “a textbook example of throwing everything at the wall to see what sticks.”The attorneys for Ivanka Trump stated that there are no allegations that she defrauded or lied to anyone.
Allen Weisselberg, the long-time Chief Financial Officer of the Trump Organization, and Jeffrey McConney, the organization’s Controller, both sought dismissal of the claims against them.In the Manhattan criminal trial, where prosecutors accused the company of 15 years of tax fraud, both of them testified as witnesses for the prosecution.
