Texas Attorney General May Face Trial

Budrigannews.com – On Monday court ruling states that Texas Attorney General Ken Paxton must face an ethics lawsuit from state attorney regulators over a case he brought challenging the results of the 2020 election.
Friday, Paxton’s request to dismiss the case on jurisdictional grounds was denied by Judge Casey Blair. Blair stated that he was not deciding the case’s merits.
Paxton has suffered a setback as a result of the decision, as he had argued that the top Texas state lawyer’s work was beyond the jurisdiction of Texas attorney ethics regulators. If the case is successful, there could be suspension or disbarment.
The lawsuit against Paxton was filed in state court in Dallas in May by the Texas State Bar, an agency that oversees licensed attorneys in the state. In the complaint, Paxton was accused of making “dishonest” statements in a lawsuit that sought to toss votes for the 2020 election in four states.
In December 2020, the election challenge was overturned by the U.S. Supreme Court.
“It is tantamount to a judicial veto over the exercise of executive discretion” to attempt to discipline Paxton, Paxton’s attorneys told the Texas court, referring to the bar’s allegations regarding his “performance of his official duties.”
Texas attorney conduct rules, on the other hand, “apply to any attorney engaged in the practice of law regardless of their position,” according to the state bar.
Paxton has previously stated that he “completely” supports the lawsuit’s filing.
A different Texas judge dismissed Paxton aide Webster’s related legal ethics case last year. Webster was also accused of making “dishonest” statements to challenge the results of the 2020 election. In that case, there is an appeal pending.
