Patagonia vs Gap-the court will decide
Budrigannews.com – The high-end outdoor clothing retailer Patagonia Inc. has filed a lawsuit against Gap Inc. (NYSE:) of illegally copying the “iconic” snapped flap pocket that it has used for more than three decades on fleece outerwear.
Patagonia claimed in a complaint filed in federal court in San Francisco on Tuesday night that Gap is selling fleece jackets without permission that mimic its flap pocket and rectangular “P-6” logo.
Patagonia said Hole’s activities subverted its altruism, and were expected to befuddle customers into accepting it made the coats or let the retailer utilize its brand names.
In addition, it claimed that Gap, which is based in San Francisco, had been warned in previous years not to copy its products, which indicates that the alleged “adoption of designs and logos bearing even more similarity cannot have occurred by accident.”
A Gap customer left a one-star online review describing a product as an “Obvious Pata*gonia ripoff” in the lawsuit. To ensure that the logo was GAP, I had to zoom in.”
On Wednesday, Gap did not respond to requests for comment right away.
