Hershey sued because of poor quality chocolate
Budrigannews.com – The Hershey Company has been sued by a customer who said that the company sold dark chocolate with too much lead and cadmium in it.
Christopher Lazazzaro stated in a proposed class action that he would not have purchased or paid less for Hershey’s Special Dark Mildly Sweet Chocolate, Lily’s Extra Dark Chocolate with 70% cocoa, and Lily’s Extreme Dark Chocolate with 85% cocoa if Hershey had disclosed the metals content of those products.
Hershey didn’t promptly answer on Thursday to demands for input on the claim, which was documented in the government court in Focal Islip, New York.
According to some studies, dark chocolate’s antioxidants and relatively low sugar content may aid in heart disease prevention.
Two weeks after Consumer Reports revealed the results of scientific testing of 28 dark chocolate bars for lead and cadmium, Nassau County, New York resident Lazazzaro filed a lawsuit.
According to the magazine, despite the fact that all 28 products contained the heavy metals, 23 products, including chocolate from Dove, Godiva, Lindt, and Trader Joe’s, contained levels of lead, cadmium, or both that could be harmful to individuals who consume one ounce of chocolate daily.
According to the magazine, Hershey’s Special Dark bar, Lily’s 70% bar, and Lily’s 85% bar all contained high levels of lead and cadmium.

According to Lazazzaro, reasonable consumers would be turned off by such levels because they pose a “serious health risk” and consumers rely on Hershey to be truthful about its product ingredients.
Under New York law, the lawsuit seeks damages of at least $5 million, including $500 per transaction.
In June 2021, Hershey paid $425 million to acquire Lily’s.
The lawyers for Lazazzaro did not immediately respond to requests for information, including whether or not they intend to file additional lawsuits.
