Amazon responsible for fake Louboutin ads-EU Court
Budrigannews.com – Amazon, an online retailer (NASDAQ:) in a preliminary ruling on Thursday, Europe’s highest court said that may be held accountable for advertising fake Christian Louboutin shoes on its platform.
The EU court stated that two national courts would now determine whether this was the case.
In 2019, Louboutin filed lawsuits against Amazon in Belgian and Luxembourg courts, claiming that the online retailer routinely displayed advertisements for red-soled shoes that had not been authorized by Louboutin.
Within the EU, Louboutin’s signature red sole is registered as a trademark. The Luxembourg-based Court of Justice of the European Union (CJEU) had been consulted by both courts.
The EU court said on Thursday that Amazon, as an online sales platform, may be blamed for intellectual property violations in advertisements for counterfeit Louboutin products with the trademarked red sole.
According to the court, this is due to the fact that the way the advertisements are presented may give users of its website the impression that Amazon, rather than a third-party seller, is in charge of the advertisements and benefits from them.
An Amazon spokesperson stated, “We will study the Court’s decision.”
According to Louboutin’s attorney, Thierry Van Innis, the European court “followed the designer’s arguments in every detail.”

He stated to Reuters that Amazon “will be forced to change their model and stop misleading the public by mixing up their own and third-party offers” and that the company “can be held accountable for the breaches as if the platform itself was the seller.”
According to Van Innis, Louboutin is not seeking financial compensation at this time. At this point, we are not talking about money. He stated, “We want the breaches to stop.”
